earlier this year ... people in san rafael's' bret harte' neighborhood are bracing themselves for the uncertainty of the upcoming wet weather. kron 4's ella sogomonian has more. this is video of a washed out road in the brett harte neighborhood in san rafael back in february. residents say they hadn't seen anything like it before and now worry about future storms coming their way this season.sot:

jeff swenerton, neighbor// "we are in the path of some of the water that's coming down we are near the top of the hill and there's a gully that's washed out before and if it happens again i think we are in the path of it."in the path is also irwin street that was reduced to a single lane after a landslide in january.sot: ella sogomonian, san rafael// "and just to give you guys a perspective of how narrow this road has really become it takes one two three four five of my little steps to get to the edge." neighbors say a city council meeting last week announced irwin street may soon be closed. sot: jeff swenerton, neighbor// "our main concern for this is safety we want to make sure that the houses below the wash are okay and nobody gets personally affected so if they need to close the road you know we will work around it." unfortunately that slide did turn into a personal problem when it ran down this slope and into the backyard of this glen air street home. the clark family is still working with the city in the clean up process. this gravel was laid out to bring trucks in that

removed 600 cubic yards of mud. but a large tarp and sanbags remain scattered across the hillside.sot: stacy clark, recovering from landslide//it's a little scary we're not sure how safe the hill is so we kind of have to watch it and monitor it and leave if we need to."the clarks say they are bracing themselves to be pushed out of their home of 16 years if the upcoming weather proves to be worse than the last time. "i've never heard anything bad about west county or read anything bad or seen anything on the internet bad about the jail or the housing conditions there. never."but that's not what 40 federal immigration detainees say.in a letter, they claim they're forced to wait hours to use the restroom, and sometimes
4:09 am
they're locked up for 23 hours a day.the contra costa county sheriff's office says it takes the allegations seriously, and has launched an investigation. but it also defended itseld againt the claimsin a recent facebook post.they explain that the undocumented immigrants are only áhoused at the facility - ice agents make the arrests, and the sheriff's office has nothing to do with their cases."if people are undocumented, then they should have a different approach and different procedure."the facebook post also says that, in addition to personal room keys, inmates have free access to leave to use any of the 24 toilets in each building.if you reviewed video of the inmates, the sheriff's office says you'd find they aren't locked up for 23 hours a day, and that they have ámore free time than is required by the state.most of the day, their doors are kept unlocked, too. some people in richmond just wish the county weren't housing undocumented immigrants in the first place. "i don't think that like the feds should be spending money to have the immigrations locked up.""i don't think it's a really good use of taxpayer money."(reporter)the statement on facebook also says the sheriff's office has never directly received complaints from the detainees about
